Terms of Service

Important: FairBench is currently in alpha. Features may change, analysis results are indicative only, and should not be relied upon as the sole basis for financial or operational decisions.

1. Acceptance of Terms

By accessing or using FairBench (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Alpha Software Disclaimer

FairBench is in active development and provided as alpha-stage software. This means:

  • Analysis results, metrics, and recommendations are indicative only and may contain errors or inaccuracies
  • Statistical calculations, thresholds, and anomaly detection are under continuous refinement and may produce incorrect outputs
  • Features may be added, modified, or removed without notice
  • The Service may experience downtime, bugs, or data loss (browser-cached data)

You should independently verify any findings before making business decisions based on FairBench outputs. The Service is a decision-support tool, not a certified measurement or compliance instrument.

3. No Guarantee of Accuracy

Energy analysis inherently depends on data quality. FairBench performs automated validation checks, but cannot guarantee that:

  • Uploaded data is complete, accurate, or correctly formatted
  • Detected patterns (anomalies, trends, correlations) represent real operational conditions
  • Financial estimates or savings projections will materialise in practice
  • Regulatory compliance narratives satisfy the specific requirements of your auditor, jurisdiction, or certification body

4. Your Data

As described in our Privacy Policy, your energy data is processed entirely within your browser. We do not have access to your uploaded files, analysis results, or generated reports.

You retain full ownership of your data at all times. We make no claim to any intellectual property rights over your uploaded data or the analysis outputs.

5. Account & Access

Creating an account is optional for the demo. For full functionality, you need an account. You are responsible for maintaining the confidentiality of your login credentials.

We reserve the right to suspend or terminate accounts that violate these terms or are used in ways that compromise the Service for other users.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable regulations
  • Attempt to reverse-engineer, decompile, or extract source code from the Service beyond what is permitted by law
  • Interfere with or disrupt the Service or servers connected to it
  • Misrepresent FairBench outputs as certified audits, official compliance reports, or professional energy assessments unless independently verified by a qualified professional

7. Limitation of Liability

To the maximum extent permitted by law, FairBench Ltd and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Changes to These Terms

We may update these terms as FairBench evolves. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via the application.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
